Terms and Conditions

Read the terms and conditions of the Historic Places, Breathing Spaces campaign before submitting your image or video.

1. What is the Wellbeing Campaign?

Historic Environment Scotland has created a wellbeing campaign entitled ‘Historic Places, Breathing Spaces’ (the “Wellbeing Campaign”) to celebrate how our sites and Scotland’s historic places can help support mental, physical, and emotional wellbeing. 

Members of the public who visit our participating sites are invited to take photos and videos, or record in writing how Historic Environment Scotland’s Properties in Care are making a positive impact on their wellbeing. We will then share a selection of these submissions in an online exhibit, and on our social media channels. 

2. What’s in these terms?

These terms and conditions (the “Terms”) set out the rules for your participation in the Wellbeing Campaign. 

3. Who we are and how to contact us

The Wellbeing Campaign is created and run by Historic Environment Scotland (“HES” or “we” or “us”), an executive non-departmental public body established under the Historic Environment Scotland Act 2014 being a registered charity (Scottish Charity number SC045925) and having its principal office at Longmore House, Salisbury, Place, Edinburgh EH9 1SH.

4. By participating in the Wellbeing Campaign you accept these Terms

By participating in the Wellbeing Campaign and making a submission to us, you confirm that you accept these Terms and that you agree to comply with them. If you do not agree to these Terms, you must not participate in the Wellbeing Campaign. 

We recommend that you print a copy of these Terms for future reference. 

You also agree to accept and comply with our general website terms and conditions 

5. There are other terms that may apply to you.

These Terms refer to the following additional terms, which also apply to your participation in the Wellbeing Campaign: 

  • Our Wellbeing Campaign Privacy Notice, which sets out information about how we may use your personal information. 

6. We may make changes to these Terms

We may amend these Terms from time to time. Every time you wish to participate in our Wellness Campaign, please check these Terms to ensure you understand the terms that apply at that time. These Terms were most recently updated on 18 June 2025. 

7. Participating in the Wellbeing Campaign

Members of the public are invited to provide photographs and/or videos, with a written summary of up to 300 words (“Submissions”) about their experiences at any of the HES Properties in Care, how these sites impact their wellbeing, and any recommended routes or places at these sites for others to discover. We will choose Submissions to share in our online exhibit relating to the Wellbeing Campaign (“Exhibit”), which can be found at Get inspired

Sending us a Submission is on a strictly voluntary basis, and we will not make any payment of any kind to you for your Submission. 

Please note that not all Submissions will be shared in the Exhibit. We will choose which Submissions will be shared, at our sole discretion, and we may from time to time change the Submissions that are shared in the Exhibit. We will retain any Submissions that we receive but do not use in line with our Wellbeing Campaign privacy notice. 

Send us your photograph or video using the submission form. You will be asked to upload your Submission, to provide us with your first name, last name and email address, to confirm that you are over 18 and resident in the UK and to confirm acceptance of these Terms.  

Any Submission that you submit as a part of the Wellbeing Campaign must have been created by you. By submitting a Submission, you explicitly agree to the grant of the copyright licence set out in paragraph 10 below. 

Where you submit photos or videos which include people’s faces, voices or anything else that can identify a person, you must have the consent of that person (or in the case of a child, the parent or legal guardian of that child) to submit the photo or video to us. By providing a Submission which includes other people, you warrant to us that you have the consent of that person or persons to submit the Submission to us. We reserve the right to remove your Submission (or part of your Submission, if applicable) from the Exhibit if a person in that Submission objects to their being included in it. This will be done by us without reference to you.  

If the Submission contains identifiable children, we may get in touch with you to confirm that you are the parent or legal guardian of any children featured in your Submission. 

In taking photos or videos, at no time should you endanger yourself or others, take any unnecessary risks or infringe the law. 

Unless we hear otherwise from you, we will credit your Submission with your first and last name in the Exhibit.

If you change your mind about submitting your Submission or your Submission being displayed in our Exhibit, please contact us as soon as possible on communications@hes.scot using the subject “Data Removal”. Please include the date of your submission, what Property in Care it relates to, and a description of the Submission. We will then delete the relevant Submission and send you a confirmation email. 

If you share photos or video from your participation in the Wellbeing Campaign on your social media pages, please tag us in your post using #HistoricScotland and/or @HistoricScotland. By tagging us in your post, you agree to HES potentially sharing your post on our own social media channels.  

8. Open only to individuals over the age of 18

The Wellbeing Campaign is only open to individuals aged 18 and older. Please do not submit any Submissions created by anyone aged under 18 on their behalf. 

The Wellbeing Campaign is only open to individuals resident in the UK.  

9. Content standards

These content standards apply to any and all Submissions.  

These content standards must be complied with in spirit as well as to the letter. The standards apply to each part of any Submission as well as to its whole. 

HES will determine, in its discretion, whether a Submission breaches these content standards. 

A Submission must: 

  • Be accurate (where it states facts);
  • Be genuinely held (where it states opinions); and 
  • Comply with the law applicable in Scotland and in any country from which it is posted. 

A Submission must not: 

  • Be defamatory of any person;
  • Be obscene, offensive, hateful or inflammatory; 
  • Promote sexually explicit material;
  • Promote violence;
  • Promote discrimination based on race, sex, religion, nationality, disability, sexual orientation, gender identity or age;
  • Infringe any copyright, database right or trade mark of any other person;
  • Be likely to deceive any person;
  • Breach any legal duty owed to a third party, such as a contractual duty or a duty of confidence;
  • Promote any illegal activity;
  • Be in contempt of court;
  • Be threatening, abuse or invade another's privacy, or cause annoyance, inconvenience or needless anxiety;
  • Be likely to harass, upset, embarrass, alarm or annoy any other person;
  • Impersonate any person, or misrepresent your identity or affiliation with any person;
  • Give the impression that the Submission emanates from HES, if this is not the case;
  • Advocate, promote, incite any party to commit, or assist any unlawful or criminal act such as (by way of example only) copyright infringement or computer misuse;
  • Contain a statement which you know or believe, or have reasonable grounds for believing, that members of the public to whom the statement is, or is to be, published are likely to understand as a direct or indirect encouragement or other inducement to the commission, preparation or instigation of acts of terrorism; or
  • Contain any advertising or promote any services or web links to other websites. 

10. Copyright licence

By submitting your Submission to the Wellbeing Campaign, you agree to grant HES a royalty-free, non-exclusive licence to use, edit and/or modify the Submission for the purpose of preparing, publishing and sharing the Submission in our Exhibit and/or on our social media.

This licence will be for a period of 5 years from the date of the Exhibit’s launch. We may also use the Submission in relation to our statutory or delegated functions. Unless you have told us you wish for your Submission to be anonymous, we will credit you as the creator of that Submission by your first name and last name any time we exhibit or use your Submission. 

However, you will still own the copyright to everything you contribute to HES. 

11. HES Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our Website and in the content published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved. 

12. Assignation

These Terms are personal to you. You may not assign or otherwise transfer any of your rights under these Terms. 

13. Our rights 

We reserve the right to: 

  • modify or withdraw, temporarily or permanently, your Submission (or any part thereof) from our Website with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of your Submission;
  • modify or withdraw, temporarily or permanently our Website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of this Website; and/or
  • change these Terms from time to time, and your continued use of this Website (or any part thereof) or participation in the Wellbeing Campaign following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Terms have been changed. If you do not agree to any change to the Terms then you must immediately stop participating in the Wellbeing Campaign.  

14. Limitation of Liability

Nothing in these Terms shall exclude or limit our liability for death or personal injury resulting from our negligence or that of our employees, agents or subcontractors, or from our fraud or fraudulent misrepresentation or any other liability that cannot be excluded or limited by applicable law. 

To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to your participation in the Wellbeing Campaign or this Website or any content on them, whether express or implied. 

We will not be liable to any user for any loss or damage, whether in contract, delict (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: 

  • participation in the Wellbeing Campaign; 
  • use of, or inability to use, this website; or 
  • use of or reliance on any content displayed on this website. 

Please note that we only provide this website for domestic, educational and private use. You agree not to use this website for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, loss of revenue, anticipated savings, business interruption, goodwill or reputation, or loss of business opportunity. 

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website or to your downloading of any content on it, or on any website linked to it. 

15. Circumstances beyond our control

We shall not be responsible for any breach of these Terms caused by circumstances beyond our control. 

6. If a court finds part of these Terms illegal, the rest will continue in force

Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect. 

17. Delays in enforcing these Terms

Even if we delay in enforcing these Terms, we can still enforce them later. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of your breaking these Terms, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. 

18. Entire agreement

You confirm that, in accepting the Terms, you have not relied on any representation save insofar as the same has expressly been made a term of these Terms and you agree that you shall have no remedy in respect of any representation which is not fraudulent. 

19. Which country's laws apply to any disputes?

These Terms, their subject matter and their formation, are governed by Scottish law. You and we both agree that the courts of Scotland will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of England or Wales, you may also bring proceedings in England and Wales.
